TRANSPARENCY OF THE ACTIVITY OF PUBLIC AUTHORITIES – A GUARANTEE OF DEMOCRACY

Abstract:
Democracy is a way of organizing the society where people choose their leaders and hold them accountable for their ruling policies and their conduct in office. Democracy is associated with representability, the state of law and the ruling in the interest of the people. In order to keep the directly or indirectly elected ones, as well as all other persons that work „for the people” accountable, their activity and conduct has to be known, has to be transparent. Usually transparency is seen as a request for the activity of the public administration, the executive power. But democracy is protected by all the state’s powers. The article analyses the means of ensuring transparency for the activity of those enacting the executive, legislative and judicial functions in Romania. Particular aspects, like the limits of transparency, the link between legal certainty and transparency and the transparency of the public consultation before legislative or executive decisions are discussed.
