Abstract:
In Romania, the role of the penitentiary and re-education centers is no longer seen as an essentially punitive and custodial one, with emphasis being placed on social integration issues, namely education and recovery. This has proven to reduce the risk of relapse and increase the chances of social integration and reintegration, especially on the juvenile delinquency area. The article outlines the factors involved in delinquent behavior of minors, the national and institutional legislative framework in relation to the criteria of democratic justice, the role of the penitentiary system, the probationary and reeducation system by the principles promoted by the vision of restorative justice where the contribution of the community and individual empowerment should play a very important role.
