EUROPEAN POLICY ON CAPACITY ALLOCATION

Abstract: As known, the EU Commission and the Agency for the Cooperation of Energy Regulators (also ACER) are envisaging the possibility to modify the balance of tasks and powers currently in place between ACER and the European Network of Transmission System Operators for Gas (also ENTSOG). Such an initiative, already foreseen by ACER through the “Energy Regulation: A Bridge to 2025 Conclusions Paper - Recommendation of the Agency on the regulatory response to the future challenges emerging from developments in the internal energy market” (also “Bridge 2025”), could be likely carried out (i) through new legislative acts (namely, amendments of the relevant Basic Regulations) and/or (ii) through implementing acts of the Third Energy Package, such as Regulations adopting Network Codes (also “NC”) drafted by ENTSOG according to proceedings provided by Regulation (EC) No 715/2009 (also “Gas Regulation”).
