CORRELATION OF THE LEGISLATIVE SITUATION REGARDING THE FORENSIC EXPERTISE CARRIED OUT BY THE EXPERT RECOMMENDED BY THE PARTIES

Abstract: A new institution, that of the forensic expert recommended by the parties, has been regulated in the field of forensic medicine. Corroborating the new regulation with the existing ones in the field, it is found that the guarantee of procedural rights, conferred by the right of the party to recommend a forensic expert, is not fully effective, on the considerations analyzed extensively in the present study.
