Abstract:
In Romania, in the past few years a constat legislative activity has been represented by the adoption of numerous legislative changes. Therefore, this led to the necessity of permanent confrontations with legal arguments regarding the interpretation and application of law. In the context of legislative changes, the new attributions of the judge, respectively of the court, in the matter of search warrants and preventive arrest has created difficulties in the interpretation and uniform application of legal texts.
