DESPRE MEDIERE ȘI ARBITRAJ ÎN SOCIETATEA CIVILĂ ROMÂNEASCĂ

Abstract:
The present paper aims at briefly analyzing the alternative dispute resolution institutions of Arbitration and Mediation and its beneficial effects on an already overburdened judicial system, in the context of the constant need for judicial efficiency. Arbitration and mediation constitute relatively new tools for conflict resolution for the Romanian civil society. While these institutions have been mainly used in commercial matters for the added efficiency and celerity that they grant to the parties involved, civil cases that could have also benefited from these tools continuously stacked up on the Romanian judiciary system’s agenda. To this end, we have structured our arguments on different points of view from both legal and other type of specialized literature, presenting some key aspects on mediation and arbitration for the Romanian civil society, on the eve of the introduction of its “New Civil Code”.
