Abstract: Drawing on the criminal codes of other states as well as the issues raised by the doctrine and jurisprudence, the new Criminal Code brings significant changes to the offense of rape, changes aimed at, among others, aspects regarding its subjects. In this paper are analyzed: the possibility for a legal person to have the quality of active subject of rape, issues concerning the quality of passive subject, the regulation of aggravated forms and its implications, etc.
