Strategies and regulatory measures for Combatting illicit mining operations in Nigeria: A comprehensive legal perspective

Abstract:
This study offers a thorough legal examination of strategies and regulatory measures aimed at addressing illicit mining operations in Nigeria. It assesses the existing legal frameworks governing mining activities in the country, highlighting their limitations in combating illicit mining. The research identifies a lack of proper oversight, resulting in inadequate control over the environmental, public health, and economic impacts of these operations. The study analyzes key legal instruments, including the Constitution of the Federal Republic of (as amended), the , the Environmental Impact Assessment Act, the Land Use Act 1978, and the Petroleum Industry Act 2021. Employing a doctrinal and conceptual legal research approach, it draws on existing literature and consultations with government, industry, and societal stakeholders. With a clear distinction between the mining of solid minerals and other forms of mining the findings reveal insufficient government regulation of illicit mining operations, undermining their effectiveness. The paper recommends strengthening existing legal frameworks and enhancing enforcement mechanisms. Additionally, it calls for increased investments in policies, strategies, and infrastructure to combat illicit mining, bolstering regulatory agencies’ capabilities. This comprehensive study equips public authorities, stakeholders, and policymakers with essential insights to curb illicit mining activities in Nigeria.
