The fishery conservation and management act of 1976: Organizational structure and conceptual framework

Abstract: The author introduces a theoretical context for discussing the organizational structure and conceptual framework of the Fishery Conservation and Management Act of 1976. He applies this to the Regional Fishery Management Councils established under the Act in order to assess the trends in their evolution and, in particular, to examine the balance between federal and regional authority over fisheries management. He concludes that structural and conceptual dichotomies within the Act provide a desirable flexibility, but could be counterproductive if the Regional Fishery Management Councils do not take specific action to commission the data that they require to fulfil the roles authorized by the Act. Without such action an imbalance could arise which would lead to their demise or subservience to federal authority and advice.
