Current trends in patenting biotechnological inventions before the European patent office

Abstract:
The article examines the evolution of the practice in the European Patent Office (EPO) in respect of (1) deposit of biological material, (2) patenting of plants, animals and biological processes, and (3) breadth of claims in the field of biotechnological inventions. The conclusion is that, while a lot remains to be done to arrive at a clear and established practice in these fields under the EPC, in 10 years a great deal has been achieved to clarify the situation.
