Obviousness and the notional addressee team

Abstract:
This article reviews aspects of the determination of inventive step, stemming from a decision in the Australian Federal Court on a patent relating to connector modules for insulated telecommunications cables. Points explored include the extent and nature of the notional skilled addressee, where that addressee is a team of experts, each with their own common general knowledge, and the admissibility of expert evidence and the weight that may be given to it once admitted.
