Abstract:
A review of the legal public service concept that is established in article 128 of the Constitution is outlined. In practice this has been superseded by article 90.2 of the Treaty of Rome that imposes application of competition rules so far as they do not prevent, de facto or de iure, fulfillment of the public service purpose in question. This means a vertical breakup of these sectors and distinguishing within them what is a public service and what is not. The concept of reservation for the public sector is substituted by the idea of a universal service, which has reached a very accurate development in the field of telecommunications, in which the European Union has accomplished one of the most complete formulations of such a service. This service is based on the principles of universality, equality and continuity in order to allow for access at an attainable price for all users, with a given level of quality, independently of their geographical situation.
