Abstract: Spanish Urban Development Law and the techniques for real estate market regulation are already forty years old, which is a sufficiently long period of time to invite -and warrant- to reflection about the principles on which the original Real Estate Law of 1956 was based, its subsequent evolution, its successive reforms in 1975 and 1990 and the global results thereof. The current situation is the result of all this, as is the excessive degree of interventionism to which that process has led. Such interventionism, considering its inadequate results, justifies a change of orientation in the legal system that would prompt an increase in real estate offer and reduce the excessive delay in urban development processes that has contributed so much to the increase in real estate and housing prices.
