Abstract: The purpose of this article is two-fold: on the one hand to present a debate on the main guidelines and development of banking regulations and on the other to set down and present a critique of the main pillars underpinning the proposal of the Basle Committee on Banking Supervision for the establishing of a new agreement on capital. Banking regulations remain important in ensuring financial stability, and seem all the more necessary in view of the new or increased risks emerging in the current environment of volatility and innovation. Specifically, prudential control through monitoring of the adequacy of equity may help bolster the solvency of organisations. However there are clear difficulties in finding the most suitable ways of evaluating and covering the risks assumed. The proposal by the Basle Committee is long and complex in its technical details, and leads us to pose several questions.
