Abstract:
In this work a description is made of the possible economic effects of the reinforcing of the Law on patents reference to the development of the biotechnological sector in the EU, special reference being made to the agricultural and food sectors. Certain factors are identified that limit the desirable objective of a greater development of innovative activity in European biotechnological companies. Among them, special attention is paid to the oligopolistic structure of the sector in which the companies act and the area of application of the patents, which condition the future evolution of the biotechnological sector in Europe. Finally, an analysis is made of the adverse effects on welfare derived from the difficulty to compensate in the negative externalities that generates a loss in agricultural biodiversity.
