Abstract: The Antitrust Policy in Spain is facing up an integral reform of the rules that pursue to give to the model a major level of efficacy, efficiency and independence. Recognising the necessity of implementing this reform, the author considers that in order that this reform could be successful, it will be necessary not only to establish a correct balance of the strengths and the weaknesses showed by the existent system, but also to identify correctly the challenges set out by the decentralization processes, that began in Europe by the promulgation of the 1/2003 Regulation.
