Abstract: Sintetiche considerazioni qualificatorie in ordine alla dismissione dei beni immobili pubblici mediante cartolarizzazione ai sensi del D.L. 25 settembre 2001, n. 351 - The securitization of governmental real estate is the object of a renewed and intense interest, mainly on the plan of economical and financial policy, as it is a fundamental instrument in order to find liquid assets for public finance. Nonetheless this particular structured finance process sets intricate problems of qualification, which necessarily influence the concrete configuration of the process of securitization de quo and, at the same time, the modality and typologies of legal actions which can be undertaken by the subjects of securitization. The present essay analyses in detail the ontology of the securitization of governmental real estate, assessing the fiduciary nature of the property right upon the real estate, sold to SPV (special purpose vehicle) or, better, SPC (special purpose company); then the private or public characterization of this particular kind of companies and, consequently, of the their acts and transactions and, moreover, the disposition of the public interests to conform the ontology and the teleology of the complex process of securitization of governmental real estates.
