Abstract: The responsibility to support offspring emanates from Natural Law and is certainly undelayable and indelegable. However, it must be subject to parameters of fairness which guarantee that children receive, from both parents, the resources needed for their support based on principles of proportionality, need, economic ability and reasonableness. This analysis reveals the Puerto Rico child support regime leads to the imposition of child support awards that overestimate, in most cases, the non-custodial parents’ responsibility for child rearing expenses thereby violating basic equity principles. This finding is based on a comparative evaluation of awards in state jurisdictions within the United States of America.
