Abstract: From a conceptual point of view the author proposes the notions of proper and improper robbery (concepts borrowed from the Italian criminal doctrine),arguing on the different degree of social danger of the two concepts. After a comparative presentation of the improper robbery in the Italian, German, Finnish and Swedish criminal law, in the Romanian Criminal code it is proposed a separate incrimination. That is either in the same article with the proper robbery but in a different paragraph or in a different article with a separate marginal name. In the latter situation the special limits of the punishment are lower than in the case of proper robbery.
