The role of unfair contract terms over Romanian private law

Abstract: Until recently good faith as a norm of conduct did not benefit from a detailed enactment in the Romanian Civil Code. However, as a result of economic development and an increase in the complexity of contractual relations, the evolution of consumer protection has led to the recognition of good faith as a governing principle in relations with consumers. The EU lawmaker had a significant impact on this phenomenon mainly by promoting consumer protection of its citizens as a major component in the process of European integration. The phenomenon of legal convergence within the EU has eased the promotion of legal concepts with general applicability such as good faith. With the entering into force of the current Civil Code, good faith has received a more detailed and frequent enactment, which in our opinion is due to the success it displayed in the process of dealing with unfair terms.
