Some Considerations Concerning the Justifications of the Administrative Acts of the European Union with Impact on Business Environment

Abstract: Within the European Union the administrative acts, adopted by its institutions must meet certain requirements and follow the principles of European administrative law. The justification of administrative acts of European law constitutes an obligation of the policy maker in the situation that those acts produce legal effects on the addressees. The European business environment characterized by strong competition from private (enterprises) is controlled by rules of law for the purpose of the development in terms of equal treatment – of a business. When the European Commission adopts a decision against some European companies has the obligation to give a justification in fact and in law of the sanctioning administrative act.
