The Extinctive Prescription in the New Civil Code

Abstract: This paper presents the new Civil regulation of the extinctive prescription, insisting on the novelties regarding the impossibility of invoking it by the competent jurisdiction bodies, the possibility of renouncing to the extinctive prescription, of modifying the duration of the prescription terms with certain limits and the causes of suspension or interruption, the appearance of new 10 years, 2 years and 1 year special prescription terms, of week and hour terms, of new day terms calculation methods, the introduction of new extinctive prescription suspension and interruption causes.
