Abstract: The article proposes a discussion about the institution of the putative deed. Since there is no explicit legal regulation, many discussions have existed and continue to exist in the specialized legal literature. We are, therefore, talking about a person who executes certain acts of execution with the intention of killing another person, without knowing that he was deceased before the moment of commencement of his activity. The article urges reflection on the importance of the intention to kill, executed against a corpse, in terms of danger to society.
