Abstract:
In the framework of this article there are examined the commitment methods of the offence provided by art.2461 “Unfair competition” PC RM: creating, throughout any possible method, confusion with the opponent enterprise, with the outputs, the commercial or industrial activity of the competitor; the propagation, in the process of commercialization, of deceitful statements, meant to discredit the enterprise, the outputs or the enterprising activity of the competitor; the misleading of the consumer about the provenience, the producing, the quality, the usage capability or about the competitor outputs amount; the use of the enterprise brand or of the trade mark in such a manner in order to provoke confusion toward another enterpriser, the one that uses legally the same brand or trade mark; the comparison, following some publicity intention of the produced or traded outputs of one of the competitor with the another’s.
