Abstract:
In the framework of this article, there are analyzed the bearings concerning the penal responsibility application for the offences, provided by art.171 and 172 from the Penal Code of the Republic of Moldova, in the face of the following aggravating circumstances: the second perpetration of the offence by the same offender; the conscious perpetration of the offence against an minor; the conscious perpetration of the offence against an pregnant woman;the perpetration of the offence by two or more persons; the offence perpetration by deliberate contamination with an venereal disease; the offence perpetration against the person in care, under protection, at education or under the treatment of the offender etc. In the view of things of the stipulations of the Resolution of the Plenum of the Supreme Court of the Republic of the Moldova nr.17/2005, there are performed several annotations and remarks important for the practicians involved in the application process of the penal responsibility regarding the sex offences. The respective content is followed on by relevant examples from the judicial practice, a thing that facilitates the interpretation intercession.
