 Is the Romanian Rule of Law Jeopardized?Claudia Gilia ()
Jurnalul de Studii Juridice, 2012, vol. 1-2, issue 4, 249-269 Abstract: Taking into consideration the way in which the state powers work and interfere in Romania nowadays, we asked themselves whether the state of law is jeopardized. In order to provide an answer to this matter, the aim of our scientific approach is to analyse several problems that our young Romanian democracy has to deal with while trying to successfully implement the principles that govern the state of law. In our study, we paused on certain risks that are threatening the present state of law, namely: the corruption, the political migration, the legislative inflation, the increasing role of the Executive over the Parliament in the law making process, the increasing interference of the political among the judicial sphere, the lack of a genuine civil society. While trying to provide an answer to our first question, we put forth throughout the research and in conclusion as well several solutions that might be taken into consideration during a future constitutional reform and might bestir the rule of law in Romania.
