Abstract:
In the European context, the religious dimension and its institutional and legislative expression cannot be ignored, requiring a careful and lucid approach. The aims of this study are to review the main legislative body that regulates the Church - state relationship and its history in EU and Romania, focusing on the right to freedom of thought, conscience and religion as stipulated in European treaties and, by bringing forth a number of European Court cases, to underline the fact that the responsibility for the interpretation of the law lies with the national authorities.
