Abstract: Adoption with a foreign element is a complex institution of private international law, which involves a series of issues regarding the resolution of conflicts of laws in order to establish the applicable material law, as well as on the resolution of conflicts of competence in order to establish the competent authorities to approve, cancel or undo the adoption. The legal coordinates of the international adoption result from the resolution of the conflicts of laws, the national regulations being uneven, although within the international or regional organizational structures there are concerns in the sense of legislative uniformity in the field. The purpose of international regulations is to create an adequate protection mechanism for minors, with the basic principle - the best interests of the minor.
