Abstract: In the present paper we aim to analyze the problem of the successional reserve in the light of the new Civil Code’s dispositions, under the following aspects: concept, legal characters and length. The other aspect of the legal institution subjected to our analysis will be classified in another paper. Taking into consideration that the New Civil Code reforms the matters of the successions in general, we wish to capture the innovations brought by this governmental decree and to appreciate their justness.
