CONSIDERATIONS ON THE LAW OF THE FORM AND THE SUBSTANCE OF THE CONDITIONS OF BILLS OF EXCHANGE AND PROMISSORY NOTES (English version)

Abstract: Establishing uniform rules related to conflict of laws in terms of bill of exchange and promissory note is an old concern of specialists in international trade, which unfortunately failed to agree on all issues they face, some of them remaining unresolved. The study submitted for analyze existing regulations in this field in Europe with existing features in English law and stipulated in the Convention adopted at the conference specialized in Private International Law Inter CIDIP I. The research also aims to highlight how the romanian legal framework tries to regulate this sensitive segment of conflicts of laws, the analysis in terms of law 105/1992 on the regulation of private international law. Theme analyzed does not claim to cover all aspects of the law applicable to bills of exchange and promissory notes, but the substance and form of these payment instruments.
