Abstract:
Criminal participation is enshrined in Chapter VII, including Article 23 to 31 of Title II of the Penal Code. Criminal Law doesn’t explain the concept of criminal participation but defines the participants. Thus, it defines what is meant by participants (Article 23), author (Article 24), inflammatory (article 25) and complicity (Article 26). Criminal participation means cooperation of several persons to commit a crime which by its nature could be committed by one offender. Romanian Criminal Code governing criminal participation, either as a legal cause of general aggravation either as a cause of special aggravation.
