Abstract: An important aspect in the analysis of the successional reserve problem3 is represented by the establishment of the successional reserve and of the available quota. As a consequence, in the present paper the calculation of the successional reserve and of the available quota will be analysed, also identifying the operations that must be done in order to determine the mass of calculation. Equally, there will be revealed the news brought, in this respect, by Law number 287/2009 regarding the Civil Code4 and there will be appreciations of its progressive character.
