Abstract: The article shows the different forms of the legal relation in the welfare state in a three level system. The system change in the social economy from a corporate system to a competitive system occurs centrally by two instruments: First by personalized budgets respectively cash value vouchers instead of payments in kind and second by public tender of services in a competitive award procedure. In case examples the practical implementation and efficiency of competitive instruments is shown under completely different framework.
