Abstract:
This article examines the manifestations of and rules governing the transformation of economic standards into law from a legal dogmatic perspective. To do so, four steps are undertaken: In the first place, possible receptors of neighbouring scientific knowledge to migrate into law are identified. Following on from this, the question of the rules governing the transformation in such a process of juridification is raised. Specific examples of the reception of economic standards are then focused in a third step. The article examines the overall economic equilibrium enshrined in the German Basic Law, the dispute around the economic constitution, the model of competition policy in antitrust and regulatory law, the standard of cost efficiency in the network industries and the current shift towards more administration-driven regulation in the energy sector. A conclusion acknowledges the varying degrees of binding effects and argues for greater sensitivity towards interdisciplinary approaches in the legal methodology.
