Abstract:
The process of modernization of European competition policy aims at rendering the action of the Commission more effective. One of the proposals put forward to this aim is to empower the Commission to adopt decisions accepting commitments offered by the undertakings in the course of the proceedings. The adoption of remedies is already provided by merger control law in the European Union and in many national antitrust legislations, notably in the United States. The analysis of the Commission's proposal in a comparative perspective tries to shed light on both its costs and benefits and provides the opportunity to discuss the role of alternative dispute resolution in antitrust matters.
