Abstract:
The article addresses the various relationships existing among the various statutes governing the energy industry [in light of the proposed] amendments to the Italian Constitutional Chart with respect to the creation of a federal state. The article discusses the various legislative and administrative competencies on the basis of the existing applicable statutes and the proposed amendments to the Italian Constitutional Chart, identifying actual or possible conflict of laws issues and outlining the rules which are applicable to matters such as localization and development of energy, import, export and purchase and sale of electric energy and local energy distribution. In particular, it is emphasized that governmental authorities should be competent with respect to the scheduling of energy production, indipendent authorities should be competent with respect to import, export and purchase and sale of energy and local authorities should be competent with respect to local distribution.
