Contratti e regolazione nel settore elettrico. Un confronto fra Italia e Regno Unito

Abstract: In the last decades the construction of electric markets has been widely explored from different disciplinary perspectives. However, scant attention has been devoted to the implications of one of the most interesting features of national regulatory systems, that is the coexistence of administrative and private law rules. Starting from the British and Italian experiences, this article tries to verify how such coexistence influences the distribution of rule-making and enforcement powers among public institutions and private actors. One of the main insights of the analysis is that the national legal traditions have a non secondary impact on two of the crucial aspects of the electric markets: access to the networks and the workings of retail markets.Il processo di liberalizzazione dell'industria elettrica è stato indagato da numerosi punti di vista. Tuttavia, una limitata attenzione è stata rivolta ad una delle caratteristiche istituzionali di maggior rilievo dei sistemi di regolazione nazionali, e cioè la coesistenza di regole riconducibili al diritto amministrativo e al diritto privato. Utilizzando gli esempi della regolazione britannica e italiana, questo articolo cerca di verificare in che modo tale coesistenza influenzi la distribuzione dei compiti di produzione di regole e di "enforcement" fra attori pubblici e privati. L'analisi mette in evidenza alcune differenze significative fra le due esperienze nel campo dell'accesso alle reti e dei contratti degli utenti residenziali, differenze destinate a ripercuotersi sull'efficacia e sull'efficienza dei rispettivi sistemi di regolazione.
