Abstract: Il contributo analizza la recente decisione del Tribunale di Primo Grado sul caso Microsoft attraverso una lettura congiunta con le omologhe pronunce nordamericane. In tale prospettiva, viene approfondito il rapporto conflittuale tra il regime di proprietà intellettuale e la normativa antitrust, ponendo particolare attenzione al flusso di informazioni quale elemento pivotale nel garantire la concorrenza attraverso l'innovazione.
