Abuse of a Dominant Position and Absence of Domain: The Ryanair Case

Abstract:
This paper concerns the relation between the «relevant market» and the «abuse of adominant position», when the «relevant market» is so excessively broadened to includeseveral markets which are dependent or connected to each other. In this case the conditionrequired to qualify the position of dominance in a specific market, that is thecompetition between companies, is no longer met.Then the «abuse of a dominant position» is no more strictly featured as provided bythe law and it becomes an atypical antitrust infringement, which may include specificfeatures of the abuse of economic dependency.
