Abstract:
Recently, in Italy the antitrust private enforcement took mainly the form of follow onnullity actions started by consumers against the bank sector in the field of guaranteesand interest rates connected to Euribor index. In his paper the Author offers a generalview of the main legal questions actually debated by the case-law, focusing in particularon the problem of the allotment of competence among the ordinary Tribunal s andthe so-called Business Tribunals.
