Exploring entertainment Observatories within the State-Regions discourse: insights after the Constitutional Court decision n. 193, October 27, 2023

Abstract: The Italian Constitutional Court’s sentence no. 193 of 27 October 2023, which concerns the regulation of the Observatories for the performing arts at national and regional levels implemented by Law 106/2022, is of particular interest for its capacity to identify the discrepancies of the multilevel governance of the entertainment sector. The paper analyses the ruling, emphasising the significance (and the aporias) of the principle of loyal collaboration, which is challenging to implement in a sector characterised by the «egocentrism » of the institutional subjects responsible for it.
