The Interest to Homeownership between Housing Discrimination and Discriminatory Mortgage Lending

Abstract:
The focus on equitable housing distribution is not a recent issue, but rather a complex matter with a long history and numerous developments, particularly in the United States, where, through contracts for deed, rent-to-own, and lease-purchase agreements, the inclination toward homeownership has always been a prevailing aspiration. This paper addresses the issue known as housing discrimination – both proxy and by disparate impact also through algorithmic redlining – as well as the discriminatory mortgage lending. After examining various Federal Fair Housing cases, the study outlines an «appropriate relief», not limited to compensatory damages, but extended to include punitive damages.
