The Bank of Italy and the power to remove the corporate officers between prudential supervision and crisis discipline

Abstract:
By transposing the EU rules (CRD IV and BRRD), the Italian legislator has recently disciplined the Bank of Italy's power to remove both the single corporate officers and the whole management and control bodies of banks. This study aims at analyzing the conditions, the nature and the function of the so-called removal, in its double configuration, in order to evaluate whether it is compliant with the efficiency and flexibility goals the supervisory toolkit should achieve to ensure an effective approach to any bank crisis.
