The European Banking Regulation Reform: From Discretionary Choices to System Flexibility

Abstract: Starting from a comprehensive analysis of the current European banking regulation, which reveals overlaps between institutions and agencies at European and national level, and gaps in both the institutional framework and application rules, the Author makes proposals aimed at coordinating the activity of institutions and competent bodies and at filling gaps in order to ensure the stability of the banking system within a framework of legal certainty. According to the A., the current evolution of European banking regulation still asks for a quick and strong EBA action for developing the Single Rulebook to complete the single market.
