Rating Liability: Analysis of Article 35-bis of the Regulation (EC) 1060/2009

Abstract:
This paper analyses the Regulation (EC) 1060/2009 and focuses on the aspects related to Credit Rating Agencies' liability. As contemporary history has well shown, ratings may turn into misleading information for market's operators. In these cases, claims for damages might arise. This work will deepen the analysis of the judicial remedies offered by the Regulation. A comparison will be also made with the liability of other financial market's operators that deal with information. This will lead to conclude that, in this field, a proper allocation of liability should take into account the whole information process.
