Abstract: Since its inception, the Italian cooperative movement has developed, in addition to traditional membership funding, a second commitment, which is recognized as the social function of co-operation by the article 45 of the Italian Constitution. First social cooperatives made this public service orientation to their corporate purpose fifty years ago, in a legal vacuum. The legislator recognized the cooperative sociali as an independent model of mutual enterprise after ten years of parliamentary discussions with the Law n. 381 in the year 1991. Thirty years later, they are facing new challenges.
