Die Allgemeinverbindlichkeit von Tarifverträgen: ein Eckpfeiler der niederländischen Arbeitsbeziehungen

Abstract: For the Dutch economy the instrument of generally binding collective agreements is a cornerstone in the relations between employers and trade unions. This article analyses the legal foundations of this instrument, the various legal requirements and procedural rules for their specific application. In addition, it deals with the significance of the AVE for the functioning and efficiency of the so-called Dutch "polder model" that is based on a strong "bargaining economy" between employers and trade unions. Finally, it is explained how the declaration of generally binding of collective agreements stabilises the Dutch collective bargaining system and how it contributes to a multi-level system of balanced collective bargaining and social policy.
