Abstract:
The mechanism for the legal extension of collective agreements (AVE) is an essential instrument for the stabilisation of the collective wage system in France. Between 85 and 90% of all industry-wide agreements in France are declared generally binding. And, the number of generally binding collective agreements in the past decade has even increased. This article analyses the concrete procedure of the implementation and its widespread implementation in France, examines the historical development and the risk to the basic function of the instrument by the decentralisation of collective bargaining. The current highest judicial power in France has recently acknowledged a greater importance of ‘economic freedom’. That calls the future of this instrument and the previous significance of collective bargaining into question.
