Finanzwissenschaftliche Analyse der Vollkostendeckung des österreichischen Justizsystems

Abstract:
The Austrian Justice system is characterized by the highest cost coverage ratio in Europe. On the one hand, the financial self-sufficiency of public services is helpful in lowering the burden on the Austrian state budget and the tax payers. On the other hand, it may endanger the equal access to justice for low-income persons due to high court fees. Analyzing the Austrian case, this paper demonstrates how a self-supporting justice system with a high cost coverage ratio can guarantee equal access to justice to its citizens. The Austrian Justice system is cross-subsidized by retributions related to non-litigious company register and land register cases. More importantly, the increased performance of the court system which is due to, among others, investments in ICT has lowered the average cost of a trial. Finally, Austrian citizens are entitled to legal assistance. Clearly, in the area of Justice, Austria sets an example to its European partners for combining healthy public finances, social policy and e-government.
