The Market Council and its Public Credentials in the Electricity Sector

Abstract: The basis of the legal status and powers of the organization of a commercial infrastructure of the wholesale electricity market and power are determined in accordance with the Federal Law of 26.03.2003 № 35-FZ "On Electricity".The key role in the functioning of the commercial infrastructure of the wholesale electricity market is assigned by the Law on Electricity to the Market Council.The Market Council is a special kind of self-regulatory organization which has not only private but also public powers in the electricity sector. This is confirmed by the presence of public competence in the sphere of implementation of quasi licensing procedures and control powers, designed form of the agreement on accession of the wholesale market to the trading system, legal regulation and organization of pre-trial settlement of disputes and corporate approval.
